These Terms of Service (“Terms”) apply to your use of brandengineworks.com (the “Website”) and to all services provided by BrandEngine Marketing & Production (“BrandEngine”, “we”, “us”). By using the Website or engaging our services, you agree to these Terms.

Using this website

BrandEngine Marketing & Production is a creative, marketing and production company based in Jamaica. You can reach us at hello@brandengineworks.com or 18763574482.
The content on this Website, including text, images, videos, renders and designs, is provided for general information and to showcase our work. You may not copy, reproduce or reuse any content from this Website without our written permission. Some work shown belongs to our clients and is displayed with their permission.
We try to keep the information on the Website accurate, but we do not guarantee it is always complete or up to date. Prices and services described on the Website may change without notice.

Project inquiries and proposals

Submitting a “Start a Project” form or contacting us does not create a contract. Any work begins only after we provide a written quote or proposal and you accept it, as described below.

Quotes, scope and approvals

  • Quotes are valid for [30] days from the date issued unless stated otherwise.
  • Each quote sets out the agreed scope of work, deliverables, timeline and price. Work outside that scope is quoted separately.
  • Design projects include [two (2)] rounds of revisions unless stated otherwise. Further revisions are billed at our standard rate.
  • You are responsible for reviewing and approving proofs, renders and print files. Once you approve a file for production, printing or installation, changes or errors found later may be charged as new work.
  • Timelines depend on you providing content, feedback and approvals on time. Delays on your side may move delivery dates.

Payments and invoicing

  • A deposit of [50%] is required before work begins unless otherwise agreed in writing. The balance is due [on completion / before delivery of final files / before installation].
  • Production, printing, fabrication and third-party costs may need to be paid in full upfront.
  • Invoices are payable in Jamaican dollars (JMD) unless otherwise stated, within [7] days of the invoice date.
  • We may pause work, withhold final files, or delay delivery or installation until overdue amounts are paid.
  • Late payments may incur a fee of [X% per month] and reasonable collection costs.

Intellectual property and usage rights

  • Once all invoices for a project are paid in full, you receive the rights to use the final approved deliverables for the purpose agreed in the quote.
  • Until payment is complete, all designs, files, photographs, video and other work remain the property of BrandEngine, and you may not use, publish or reproduce them.
  • Concepts, drafts and unused designs not selected remain the property of BrandEngine.
  • Photography and video: unless the quote states that full rights are transferred, BrandEngine keeps copyright and you receive a licence to use the content for your business marketing.
  • Editable source files (for example, layered PSD or AI files, 3D project files and raw footage) are not included unless stated in the quote.
  • You confirm that any logos, images, text or materials you provide to us are yours to use, and you are responsible for any claims arising from them.
    We may display completed work in our portfolio, website, social media and marketing materials unless you ask us not to in writing before the project begins. We will not share confidential information or pricing.

Third-party suppliers and installation

Some services, such as printing, fabrication, installation, equipment and event services, may be carried out by trusted production partners. We coordinate these on your behalf, but we are not responsible for delays or issues caused by third parties beyond our reasonable control. Printed colours may vary slightly from on-screen colours due to materials and processes.

Limitation of liability

For signage, wraps, displays and event builds, you are responsible for providing safe access to the site, any permissions or permits required, and accurate measurements if you supply them. Additional work caused by unexpected site conditions may be charged separately.
If you cancel a project after work has begun, the deposit is non-refundable, and you will be charged for all work completed and costs already incurred up to the cancellation date.

Custom-produced items, such as printed materials, fabricated pieces and wraps, cannot be refunded once production has started.

Event and production dates may be rescheduled by mutual agreement. Additional costs caused by rescheduling may apply.

Changes to these terms

We may update these Terms from time to time. The version posted on this page applies from the “Last updated” date. Terms agreed in a signed quote or contract take priority over these general Terms.
